Divorce mediation may be ineffective in a couple of scenarios

Getting divorced in New Jersey can be one of the toughest experiences one may have, but not all divorces are bitter battles. It is possible for a couple to get a divorce without necessarily having to go to trial thanks to a process known as divorce mediation. However, mediation will not work in a couple of scenarios.

First, divorce mediation — where two spouses work with a neutral third party to reach an agreement on matters such as asset division — is not ideal for those who have trouble advocating for themselves. Failing to stand up for oneself will only allow the other party to get his or her way. Unfortunately, this may be personally detrimental in the short run or the long run.

In addition, mediation may not work for those who are in a hurry. After all, this process is not necessarily speedy. Reaching an agreement that actually meets both parties’ needs — and the needs of any children involved in the divorce — simply takes time.

With mediation in New Jersey, the third party will help both spouses to communicate with each other as they sort out their issues and strive to come to an agreement on them. For instance, if children are involved in the divorce, the parents can work on a parenting agreement that reflects both parties’ desired arrangement while also taking into consideration what is in the children’s best interests. An attorney can offer guidance during each session of the mediation process to ensure that one’s rights are protected and one’s desires are upheld.
